Viral Creator Club Terms

These Viral Creator Club Membership Terms ("Terms") apply to your subscription to the Viral Creator Club™ Program and supplement the Viral Creator Club Membership Agreement and the Terms of Service ("Terms of Service") (https://courses.tmsmedia.io/terms-of-service). Capitalized terms have the meanings set forth in the Terms of Service unless otherwise noted.

1. Program Features

As a member of the Viral Creator Club Program, you receive access to comprehensive training and resources, including:

• Training Modules. Lessons on organic social media, selling on social media, paid advertising, camera and gear recommendations, studio setup tutorials, confidence on camera, profile setup, staff training, and automated funnel setup.
• Clinics & Workshops. Multiple weekly sessions, such as coaching with Mitchell Kucher and Stephen Kucher, sales clinic, content clinic, paid ads clinic, custom program roadmap planning, and editor & social‑media manager staffing clinics.
• Content Library. Access to sample assets, graphics, B‑roll clips, audio effects, editor management guidance, file‑management processes, editor employment contract templates, hiring best practices, and a content library management system.
• Proprietary Tools. Use of proprietary AI‑powered writing software and content‑library tutorials. 

Access to program features and materials is granted only while your membership is active and in good standing. TMS Media may update or modify features to reflect product improvements.

2. Clinics and Workshops

• Group Call Format: The Client acknowledges and agrees that unless otherwise stated by TMS Media, the live clinics and workshops are group calls, not private one-on-one sessions. TMS Media reserves the right to include as many participants as it chooses to these sessions, and there is no limit to the number of clients or attendees who may be present.
• No Privacy Guarantee: The Client understands that discussions, questions, and information shared during Clinics and Workshops may be heard by other participants. The Client should use discretion when sharing sensitive business information during these calls.
• Schedule: Clinics and Workshops are currently scheduled in accordance with the calendar provided upon enrolment in the program. The specific time will be communicated to the Client upon enrollment and may change from week to week.
• Company's Right to Modify: TMS Media reserves the absolute right to cancel, reschedule, or modify the timing, frequency, or format of weekly coaching calls at any time and for any reason, with or without notice.
• No Make-Up Obligation: The Company will do its best to make up canceled sessions, but it is not obligated to reschedule or provide alternative sessions for any weekly coaching calls that are cancelled by TMS Media.
• Client Responsibility: It is the Client's responsibility to attend scheduled calls. TMS Media is not responsible for the Client's inability to attend due to scheduling conflicts, technical issues, or any other reason.
• Recording Access: TMS Media may, but is not obligated to, provide recordings of coaching calls. Access to recordings, if provided, is at the Company's sole discretion.

3. Member Participation

The Viral Creator Club Program is intended for entrepreneurs, businesses, and professionals. By enrolling in the Viral Creator Club Program, you affirm that you are entering into this relationship solely for business or commercial purposes and not for personal, family, or household use. You acknowledge that the membership constitutes a business‑to‑business (B2B) transaction and, to the maximum extent permitted by law, waive any statutory cooling‑off or rescission rights applicable only to consumer contracts.

4. Refund & Payment Conditions

Membership comes with a 24‑hour refund policy as described in the Viral Creator Club Membership Agreement and the Terms of Service. Beyond this period, no refunds, credits or prorated billing are offered. You may terminate your membership anytime via email to [email protected]; your access continues until the end of the current paid period. Re‑enrollment after cancellation requires acceptance of the then‑current terms and pricing.

TMS Media reserves the right to discontinue the Viral Creator Club Program at its sole discretion. In the event TMS Media elects to terminate the program, members in good standing who have not violated these Terms will receive a prorated refund for any remaining months of their paid membership period.

5. 10 Million View Guarantee

TMS Media offers a 10 Million View Money‑Back Guarantee for annual members. If you fail to obtain 10,000,000 cumulative views within twelve months of active membership, TMS Media will refund your membership fee, provided you satisfy the conditions outlined in the Viral Creator Club Membership Agreement. The guarantee start date is your initial enrollment date into the Viral Creator Club Program. You must receive, review, and sign the Viral Creator Club Membership Agreement in order to be eligible for this guarantee.

6. Membership Agreement

Upon enrollment, you will receive an actionable Membership Agreement via email. Signing is optional; however, you must sign the Membership Agreement to qualify for the 10 Million View Guarantee. If you experience issues receiving or signing the Agreement, contact [email protected] before enrolling in the Viral Creator Club Program.

7. Force Majeure

TMS Media is not liable for delay or failure to perform obligations under these Terms due to events beyond its reasonable control (e.g., acts of God, wars, terrorism, riots, embargoes, labour disputes, cyber‑attacks, pandemics or shortages). Obligations are suspended for the duration of the force‑majeure event.

8. Governing Law & Dispute Resolution

These Terms are governed by the law of the Province of British Columbia. All disputes shall be resolved through binding arbitration in accordance with the laws of British Columbia. Judgment on the arbitrator's award may be entered in any court having jurisdiction. See the Terms of Service for full details on dispute resolution.
