User Testimonial Terms Of Service

These Testimonial Terms of Service (this "Addendum") form part of, and are governed by, the TMS Media Terms of Service (the "Agreement,") last updated on the date listed above. By accessing or purchasing any TMS Media Products or programs ("products"), you agree to be bound by this Addendum. If you do not agree, you may not use TMS Media's products.

Testimonials and Marketing Rights

1. Grant of Rights

By purchasing any product or service from TMS Media Inc. ("we," "us," or "our"), you automatically grant us a worldwide, perpetual, royalty-free, irrevocable license to use, reproduce, distribute, and display:

• Your name, likeness, image, voice, and biographical information
• Any results, outcomes, achievements, or testimonials arising from your use of our products or services
• Any content, feedback, reviews, or communications you provide to us

2. Scope of Use

This license permits us to use the above materials in any and all marketing, promotional, and advertising materials, including but not limited to:

• Website content and landing pages
• Social media posts and advertisements (Facebook, Instagram, YouTube, LinkedIn, etc.)
• Email marketing campaigns
• Sales presentations and webinars
• Print materials and promotional collateral
• Case studies and success stories
• Video testimonials and interviews

3. Automatic Opt-In

You acknowledge and agree that you are automatically opted into these marketing rights upon purchase. No additional consent or compensation is required for us to exercise these rights.

4. Right to Edit and Modify

We reserve the right to edit, modify, alter, crop, or otherwise change any testimonial, content, image, or material you provide or that arises from your use of our products or services. 

You acknowledge that we have sole discretion in determining how your testimonial and materials are presented and used in our marketing efforts.

5. FTC Compliance and Truthfulness

You represent and warrant that any testimonial, review, feedback, or statement you provide to us:

• Is truthful, accurate, and based on your genuine experience with our products or services
• Complies with all Federal Trade Commission (FTC) guidelines and regulations regarding testimonials and endorsements
• Does not contain false, misleading, or deceptive statements
• Reflects your honest opinion and actual results

You acknowledge that providing false or misleading testimonials may violate federal law and agree to indemnify and hold TMS Media Inc. harmless from any claims, damages, or penalties arising from false or non-compliant testimonials you provide.

6. Opt-Out Procedure

If you wish to opt out of this testimonial and marketing rights agreement, you must provide written notice via email to mitchell@tmsmedia.io. Your opt-out request must include:

• Your full name
• The product(s) or service(s) purchased
• The date of purchase
• A clear statement of your intent to opt out

Upon receipt of your written opt-out request, we will cease using your testimonial and marketing materials in future campaigns. However, we reserve the right to continue using materials already published or distributed prior to receiving your opt-out notice for a period of up to 180 days from the date of your opt-out request. After this 180-day period, we will make commercially reasonable efforts to remove your materials from active marketing campaigns.

7. No Compensation

You acknowledge that the use of your testimonial, name, likeness, or results does not entitle you to any compensation, royalties, or payment from TMS Media Inc.
